I hope you guys are happy. I went this far to creating an account just to flame this place. It's BS what you did to one of your fans and you should be ashamed. I don't recall that filming a tv screen from one's living room is considered copyright infringement! You unrightfully got his account suspended and you should be embarressed. I please ask that as a fellow fan of SOME of your games, to please remove the claim and therefore the suspension on DarksydePhil's youtube account. Please please, for the sake of 60,000 people.

To clarify the situation, contrary to what was previously indicated in the message displayed when trying to access the video concerned at http://youtube.com/watch?v=mysgLYyiHic , Ubisoft did not send a Takedown notice for Copyright Infringement concerning the channel DarksydePhil,
To avoid confusion, the message has now been updated, as Ubisoft is not at the origin of the takedown notice.
The takedown notice concerned a video for Splinter Cell Conviction, which lead viewers to believe that the takedown initiative was connected to Ubisoft, while in fact the notice was initiated by a third-party user with no affiliation to Ubisoft.'

Problem here is, anyone can report a video that supposedly breaks copyright infringement. Yep an everyday user can.
Although I agree, that playthroughs are not really breaking any law, it is technically on the precipice of lawful/unlawful teetering over the edge of copyright infringement cliff.
Perhaps the full story hasn't been told, mayhap he has been asked to stop posting specific things and continued to do so.
I have no idea. And I doubt we will get the full truthful story from both sides.
Unless his playthroughs shown him bypassing Online Authentications or something, then sure it was inevitable.

im a darksydephils fan and i have whatched nearly every video from him and i havent seen anything wrong about his videous nearly everybody does make playthroughs to youtube its not a crime

Ok, I am a huge fan of darksydephil, is anyone here that is a employee of ubisoft or anyone that has got to do with this copyright claim? This is totally fake, he has been banned for just uploading a splinter cell video and please ubisoft, please remove the copyright claim, he got 60,000 subscribers.

WE WANT A STATEMENT, dsp rules ... and if ubisoft did'nt do anything than they should contact youtube and tell that to them. I mean 60k Subscribers

Darksydephil's playthroughs only help gaming companies by promoting the game he plays, almost completely regardless how critical he himself is of it. In his borderlands playthrough he complained about the game alot, but I still went out and bought it because I saw him play it. People aren't basing their purchases on his opinions, the consumer can make their own opinion on the game from watching him play it. I was thinking about getting splinter cell even though he didn't like it. He had 60,000 people subscribed to him, and his playthrough videos got thousands upon thousands of views. Ubisoft, you are missing out on ALOT of revenue getting darksydephil suspended. Because of this, many thousands of people know ubisoft for doing this, and won't buy your products, including me, until you let up on the copyright claim. I really hope you guys see what you did wrong.
