    "poor" guy?

What the heck were they doing driving with their door open anyhow? I think this is the reason they have laws about what you can and what you cannot do while in a moving motor vehicle. If that guy died being a ******* I only have sympathy for his family.

It is probably the drivers' fault, not the guy who fell out.

?? From when I saw it, it looked like the kids in the back seat wanted to go out and grab the guy on the bike or something and one of them loss his balance and fell out of the car. How is that the driver's fault? Well, obviously the blame will ultimately fall on the driver for allowing for such activity while he is in control of the vehicle, but speaking from a logical stand-point, they are all idiots and equally at fault for what happened.

Im pretty sure he is dead, 2 cars driveing 20- 30 miles/ h frontal hit head vs Car.
another proof how stupid teens can be and unfortunatley just have nonesense in their heads. Well on the other hand its survival of the fittest.

there are so many stupidity film going around, like the one where the teens put xxxxxx & alcohol in the bottle and shake it.. .Boom and he loses his arm. where it is really common sense you dont mix these 2.

the one where the Teen holds explosives in his mouth, boom.... and? yes loses his front teeth

    Hope so.

It does look as though he was trying to grab the kid on the bike.

And while I cant speak for every state in the US, If the kid was older than 16 (that fell out of the back seat) The driver is not liable, UNLESS, he had prior knowledge that the guy was going to lean out of his car. Same applies for littering in most states. If the passenger of a car commits a violation (Littering (for this example)) the driver is not liable as the passenger is responsible for his own actions and the driver's focus is the road. It might be 18 also.

We had a neighbor killed, when I was in Tampa, in school, that stcuk his head out of the window of a car he was a passenger in to yell at a vehicle behind him. The driver did something that moved the vehicle close to a pole/object in the road and it struck thge passenger in the head.... killing him. The driver was cited with speeding only. My neighbor (who was 17) was "legally responsible for his own death due to neglegence(sp)" and the family had no legal base to sue the driver. I still am pretty sure it went to civil court as the family stated the speeding is what was the main cause of the loss of control of the vehicle, thus killing their son... as opossd to the idiot's sticking his head out of the window.

If u watch it closely you can see that the other car is just parked there, so the collision isnt as bad as it could have been. If the other car had been goin 20-30 mph, then that kid would have lost his head.
