I suppose if you can prove it caused almost that much in damages, sure. The problem with libel, though, is there has to be malicious intent. If people are on Facebook forming groups against him in protest of what he's done when he was a lawyer, I would bet money that it does not constitute libel. come to think of it jack thompson should be given that 40$ mill. He's gone through a lot just to speak his mind. After he gets the money though there should be contest to see how long it will take before some one kills hims gta style and take that 40$mill and that way he gets what he wants and what he deserves at the same time, and we finally get rid of him.
