i read several times of people having to pay million dollars fine for having illegal mp3
currently im copying drawings of donald duck and im thinking of telling a story with donald duck(not intending to make profit) is this legal? or copyright is crazier than i think |

well all the better then besides the pleasure of drawing ill have that one of breaking the law
hell but then all kids are criminals not respecting copyright edit: but what id like to know is if i could get into trouble if i published online not intending to get profits a science fiction comic with very similar ducks to disneys, of course i wont call him donald but luxduck and theyl be quite different due to my not very good drawing edit: here some of my copyright infringements: would be enough change the clothes into something cooler and change his name to avoid copyright problems? |

Considering the very aggressive attitude always displayed by Disney company towards intellectual property issues, I'd think twice or thrice, Raaaid. Specially since you are unemployed and can't afford it -do you really want to put your mom in trouble for your "pleasures"?
That, if you attempt it in other site. If you try in THIS site, you'll be directly against TOU rules and may be kicked out from the forum. Make your own character -preferably one not resembling a copyrighted product. |

Copyright laws? The most important thing to avoid is using copyrighted material in a way that could keep the orgininal copyright owner from making money. In other words, if you make money from it that is money the original copyright owner didn't make so you have damaged him. Damages are the big point of contention. Yet, you probably cannot get away with violating any copyrights concerning DISNEY. Disney has a legal department that is dedicated just to copyright enfringement prosecutions. Disney is constantly searching all over the web and other media looking for copyright violations. Disney is very litigious about violation of their copyrights, where other similar companies may basically wink at them. |

i mean im utterly convinced i havent broken any norm for drawing donald duck and ask for opinion(would not be the same if i was asking money for it) or did i? and children who draw can be demanded millions edit: thanks guys i think im gonna create characters based on my favourite animal sparrows theyll have wings and need not arms due to being telechinetic but then why should they need wings, humm better with arms |

Yes, it is still illegal even if you are not asking for money. However, you are probably infringing on a TRADEMARK rather than a copyright in this case. Still the same thing though. The reason they go after everyone is b/c they HAVE to do that if they want to retain the trademark. If you don't enforce it with everyone, then you can't enforce it with anyone. Obviously you can't get blood from a turnip nor is it feasible or reasonable to do so, therefore, kids drawings are not prosecuted although, technically, they could be. --Outlaw. |
