Who is held accountable for having the download available beyond it's actual trial period?

I downloaded this game thinking I'd be able to play since I reside in the US. Had some problems trying to get it to play, So I downloaded it three times thinking my downloaded files were corrupt. As of yesterday, the false advertisement it was still up on GameSpot.com

To further frustrate the process, there wasn't any notice that the download was was only valid for labor day. Is anything being done to address the issue?

I'll bet there are thousands of disappointed return customers. I am one of them.
