I don't understand the wording of the ninth amendment in the us constitution, anyone care to help?

It means that laws can't be passed, or the Constituion or Bill of Rights interpretated in a way, that will hinder or the deny the rights and privelages of any US Citizen.

Example, a law can't be passed that would prohibit young Californian men and boys from rock climbing. Either allow all Americans to rock climb or none. No favoritism or undue singling out.

I'm not an expert in this, but from what I read, listing all the fundamental rights of the people would be impossible, and the government would have no obligation to provide for those that were omitted. 9th amendment protects these unspecified rights. hope this makes sense http://ubbxforums.ubi.com/infopop/emoticons/icon_wink.gif

One Constitutional scholar aboard.

The intended use of this amendment was to grant inherit rights to people even if they aren't specifically stated in the Constitution. This leaves open for interpretation such rights as Privacy, which isn't specifically granted, but when you combine the 9th amendment with the 4th amendment (search and seizure) with British Common Law, every Court has upheld that every individual does indeed have the right to "the expectation of privacy."

There are just too many specific rights, life, liberty to enumerate in those first 10 amendments (The Bill of Rights) that our founding fathers ensured that ALL rights wouldn't be overlooked by Federal or State Law just because they aren't specifically listed in the Constitution.

I'm afraid I'm with Jojo on this one . The way I see it is that it means that you can't change your constitution , but if you can find a cute new name for a group of people , that they lay outside the constitution . Therefore they have no rights .

Oh et is likely correct on what it was meant to mean , but what something was intented for and what it is used for can be two different things altogether .

Don't confuse the Constitution with the Patriots Act (Parts 1 and 2). We can change our Constitution...hence, all those added amendments after the Bill of Rights, but those first 10 are the most sacred, and the process of change is a pain.

The Supreme Court has agreed to hear a case against the Patriots act in the Spring Session. Considering there are so many strict Constitutionalists on the bench, I think a lot of people "being detained" are going to find themselves released.

And I ignore the Patriots Act as even existing, since I didn't waive my rights, and Congress didn't have the power to do it for me. And I have friends at the ACLU should anyone wish to disagree with my attitude.

As for airport security adding the address and name of where you will be staying...they won't be seeing any of my money. Like I have any to spare! http://ubbxforums.ubi.com/infopop/emoticons/icon_rolleyes.gif

But the 9th amendment is still the one most invoked in writing new law and challenging laws in existance.
