Okay, so I trust that most of you are pretty honest, so I want to share a REALLY bad eBay transaction I had that escalated into a Paypal claim.

Okay, so one of my favorite perfumes in Vera Wang by..yea Vera Wang. I ran out recently so I went to eBay to see if there were any bottles for good prices. I found one that I ended up buying for $38. I paid for the auction seven minutes after it was over according to records, and the seller shipped the perfume.

However, the seller somehow miss-shipped the package as it was returned to her, and she wanted *me* to pay for her to reship it. http://forums.ubi.com/images/smilies/34.gif

I made it clear under NO certain terms was that going to happen and gave her a time period in which to refund my money, shipping included, or I would make a claim with Paypal. The seller didn't refund my money and now we are waiting for a Paypal Dispute Specialist whatever do decide our case.

I really don't see how I did anything wrong or why I should be expected to pay..twice. But I figure in this situation I am blinded by my own opinion, so I thought I would ask you guys.

Yeah, sounds like a distributor error, not a consumer.

BTW...How big of a bottle are you getting for $40?

Jackie Fiest

It's a 1.7 ounces (50 ml) bottle. Very good size. http://forums.ubi.com/groupee_common/emoticons/icon_smile.gif This one should last me awhile.

http://www.heavenlyperfumes.com.au/upload/384_cat.jpg

But, since I didn't pay for her to reship, and I have an event coming up soon I wanted the perfume for, I rebid on a gift set which is the big bottle, a smaller bottle, and bottle of the scented lotion and scented bath gel for $47. http://forums.ubi.com/groupee_common/emoticons/icon_biggrin.gif

Now if I can get Paypal to hurry up with their decision I can move on from this.

You tell the seller to go to hell, you shouldn't pay for shipping twice because she screwed it up. http://forums.ubi.com/groupee_common/emoticons/icon_smile.gif

i think you should have to pay for shipping again. you bought the product. I mean it IS your fault that the seller was too stupid to put on the right address. For shame jackie! http://forums.ubi.com/images/smilies/51.gif

Her fault, she should pay for shipping for mislabling the package originally. If not, she should refund your money.

Jackie we deal with this everyday being we are a billing facility at my job.

You are the consumer. She is the seller. You paid one time for an item to be shipped. It is her resonsibilty to make ammends if there are any returned shipping problems. As long as the right address was on the package.

In most cases we deal with the venor(seller) issues a credit for lost or damaged products and we the billing facility use it to pay the dealer(consumers) bill. The vendor will reship the product at their cost. That is the way it works. At the least she should refund your money, because now she has your money and still has your product.

Exactly. I've got to a point where I've got so upset with this woman I pointed that out to her and called her a fraud. The negative feedback, which she admitting to leaving to "get even" with me is the first negative feedback I have recieved since like '02. If I ever see this woman in person Imma leave a imprint of my ring on her forehead.

I have a feeling she would have returned my money, minus the shipping, but that's why I made a Paypal claim. I want the shipping amount back as well. I'm not going to pay because she is a n00b.

Why can't you just buy it in the store? It's maybe more expensive, but you are certain:
a: it's there
b: it's what it says it is
c: you can slap the seller in the face if it's not good.

The reason I didn't buy it from the store is price. The shipper who actually managed to get my product to me, sent me a gift set. The big bottle, the little bottle, a bottle of scented lotion and sceneted bath gel. Plus shipping it was $48.

Another eBay auction I won was for the scented powder, which I got for $22, shipping included.

So...$48 + $22 = $70 on eBay for two bottles of perfume, lotion, bath gel and powder.

To buy just the perfume from a store would have been about $70 according to the store I called.

And believe me I may get to, metaphorically, slap that seller anyway. Through buyers protection with Paypal I may be eligible for atleast $1,000. http://forums.ubi.com/groupee_common/emoticons/icon_smile.gif http://forums.ubi.com/images/smilies/59.gif

Jackie: you are a woman, correct? And woman are violent, correct? Then unleash your estrogen-based violence upon those who dare oppose you!
Walk up to the seller. You say "HO!", pimp slap her like Hue Heffner wouldn't, and make off with the goods before she regains consciousness. The end! Cut! Print it! Break for sushi! Scworld's buying. http://forums.ubi.com/groupee_common/emoticons/icon_biggrin.gif
But seriously though, you present your case to Paypal or civil court or whatever, and there's no reason you shouldn't win. All there is to it.
In fact, take it to Judge Judy! http://forums.ubi.com/images/smilies/16x16_smiley-very-happy.gif Not only will you win, Judy will probably make fun of the seller for being so dumb!

so jackie whats up any new news??

Jackie Fiest
02-23-2008, 08:38 AM
Actually, yes.

The night before last I was getting pretty fed up with how long it was taking for them to handle my case. It had been 3 weeks to the day after I had made my complaint, and there had been no movement.

So, I got on the phone to Paypal. The guy took my info to bring up my account, and took about two minutes to read what had been written by the seller (which was basically "It's not my fault if USPS messed up.") then asked me for my side of the story, so I told him. I ended it with "I really think this is an open and shut case, but it appears no one has looked at it."

...and he agreed with me and refunded my money right there on the phone. http://forums.ubi.com/groupee_common/emoticons/icon_smile.gif

Paypal always sides with the buyer, no matter who is right.

That's a real problem when you're the seller and the buyer screws you over.
