Yea i had same problem. Works in retail version tho. So no worries if you buy the game.

Does the thermal work for you in single player? I remember I had problems with nightvision mode in Splinter Cell 1. The game started to lag badly. I would guess your graphic card drivers dont really support the way Splinter Cell 2 handles the thermal vision. Have you tried removing your current drivers then install the latest + latest direct x ?
